본 개인정보처리방침은 유한회사 에이펙스펀드앤코퍼레이트서비스코리아 (이하 “회사”)에서 제공합니다. 

This Privacy Notice is issued by Apex Fund and Corporate Services Korea Limited (“Company”). 

1. Who are Apex? 

회사는 주로 펀드 관리 및 기업 서비스를 제공합니다. 회사는 Apex Group  Limited (회사 및 Apex Group Limited의 기타 자회사를 통칭하여 이하 "Apex Group")의 계열사입니다. 

The Company principally offers fund administration and corporate services. The Company is a wholly owned subsidiary of Apex Group Limited (the Company and other subsidiaries of Apex Group Limited together are hereinafter referred to as “Apex Group”). 

2. What is this Privacy Notice? 

회사는 정보주체의 개인정보를 수집, 처리, 이전, 보호하는 방법을 전반적으로 설명하는 개인정보처리방침을 제공하고 있습니다. 이 개인정보처리방침은 대한민국의 개인정보보호법 및 관련 법령에서 요구하는 공개사항을 안내합니다. 만약 이 개인정보처리방침과 회사 및 회사의 관계회사가 제공하는 다른 개인정보처리방침의 내용이 상이할 경우 대한민국에서는 이 개인정보처리방침이 우선 적용됩니다. 

The Company provides this privacy notice (this “Privacy Notice”) to give an overview of how we collect, process, transfer, and protect the personal information of our data subjects. This Privacy Notice presents the matters that need to be disclosed as required by the Personal Information Protection Act of the Republic of Korea (“PIPA”) and applicable laws. In the event of any discrepancy between this Privacy Notice and any other privacy policies provided by the Company and our affiliates, this Privacy Notice shall take precedence over such other privacy policies in Korea. 

3. What personal information do we collect and why do we collect your information? 

회사는 다음의 목적을 위하여 개인정보를 처리합니다. 회사가 처리하고 있는 개인정보는 법률에 의한 경우가 아니고서는 다음의 목적 이외의 용도로는 이용되지 않으며, 회사는 이용 목적이 변경되는 경우에는 개인정보보호법에 따라 별도의 동의를 받는 등 필요한 조치를 이행할 예정입니다.  

We process personal information for the following purposes. The personal information processed by us will not be used for any purposes other than the following purposes unless required by law, and, in the event of any changes to the purpose of use of the personal information, we will take necessary measures, such as obtaining separate consent in accordance with PIPA. 

4. How do we use your personal information and how long will we store your information for? 

회사는 법령에 따른 개인정보 보유·이용기간 또는 정보주체로부터 개인정보를 수집 시에 동의 받은 개인정보 보유·이용기간 내에서 개인정보를 처리 및 보유합니다. 각각의 개인정보 처리 및 보유 기간은 다음과 같습니다. 

We process and retain personal information in accordance with the periods of retention and use of personal information set out in the laws and regulations or within the period of retention and use of personal information consented to by the data subjects when the personal information was collected from them. The periods for processing and retaining personal information are as follows. 

• 만 14세 미만 아동의 개인정보 처리에 관한 사항 
  Matters Concerning Processing of Personal Information of Children Under 14 Years of Age 

회사는 만 14세 미만 아동에 대해 개인정보를 수집할 때 법정대리인의 동의를 얻어 해당 서비스 수행에 필요한 최소한의 개인정보를 수집하며, 이 때 법정대리인의 성명, 관계, 연락처를 함께 수집합니다. 

When collecting personal information of a child under the age of 14, we collect the minimum personal information necessary to perform our services with the consent of their legal representative, and collect the legal representative’s name, relationship with the child, and contact information. 

회사는 만 14세 미만 아동의 개인정보를 수집할 때에는 아동에게 법정대리인의 성명, 연락처와 같이 최소한의 정보를 요구할 수 있으며, 다음 중 하나의 방법으로 적법한 법정대리인이 동의하였는지를 확인합니다. 

When we collect personal information from a child under the age of 14, we may require the child to provide the minimum information, such as the name and contact information of their legal representative, and we confirm that the legal representative has duly provided his/her consent to the collection of personal information in one of the following ways: 

• • 동의 내용이 적힌 서면을 법정대리인에게 직접 발급하거나, 우편을 통하여 전달하고 법정대리인이 동의 내용에 대하여 서명날인 후 제출하도록 하는 방법;
    by issuing a written document containing the details of the consent directly to the legal representative, or delivering it by mail, and having the legal representative sign and submit the document; 
  • 동의 내용이 적힌 전자우편을 발송하여 법정대리인으로부터 동의의 의사표시가 적힌 전자우편을 전송받는 방법;
    by sending an email containing the details of the consent to the legal representative, and receiving an email that indicates the consent from the legal representative; 
  • 그 밖에 위와 준하는 방법으로 법정대리인에게 동의 내용을 알리고 동의의 의사표시를 확인하는 방법.
    any other methods similar to the above to inform the legal representative of the details of the consent and verify the indication of their consent. 

• 개인정보의 파기 
  Destruction of Personal Information 

회사는 개인정보 보유기간의 경과, 처리목적 달성 등 개인정보가 불필요하게 되었을 때에는 해당 개인정보를 파기합니다. 

We destroy personal information when it becomes unnecessary, such as due to the expiration of the personal information retention period or the achievement of the purpose of processing the personal information. 

회사는 정보주체로부터 동의 받은 개인정보 보유기간이 경과하거나 처리목적이 달성되었음에도 불구하고 다른 법령에 따라 개인정보를 계속 보존하여야 하는 경우, 해당 개인정보를 별도의 데이터베이스(DB)로 옮기거나 보관장소를 달리하여 보존합니다. 

If we are required to continue to retain personal information in accordance with other laws and regulations even though the retention period consented to by the data subjects has elapsed or the purpose of processing has been achieved, we shall transfer the personal information to a separate database or preserve it in a different storage location. 

회사는 전자적 파일 형태로 기록·저장된 개인정보는 기록을 재생할 수 없도록 파기하며, 종이 문서에 기록·저장된 개인정보는 분쇄기로 분쇄하거나 소각하여 파기합니다. 

We destroy personal information recorded and stored in the form of electronic files in a way that such may not be recovered or reproduced, and destroy personal information recorded and stored in paper documents by shredding or incinerating them. 

5. Who do we share personal information with? 

회사는 정보주체의 개인정보를 개인정보의 처리 목적에서 명시한 범위 내에서만 처리하며, 정보주체의 동의, 법률의 특별한 규정 등 개인정보 보호법 제17조 및 제18조에 해당하는 경우에만 개인정보를 제3자에게 제공하고, 그 이외에는 정보주체의 개인정보를 제3자에게 제공하지 않습니다. 

We process personal information of data subjects only within the scope specified in the purpose of processing personal information above, and provide personal information to a third party only in cases falling under Articles 17 and 18 of PIPA, such as in the event that the data subjects provide consent therefor or under special provisions of the law, and otherwise we do not provide personal information of the data subjects to a third party. 

회사는 원활한 서비스 제공을 위해 다음의 경우 정보주체의 동의를 얻어 필요 최소한의 범위에서 정보주체의 개인정보를 제3자에게 제공합니다. 

For the purpose of facilitating the provision of our services, we provide personal information of the data subjects to a third party to the minimum extent necessary, with the consent of the data subjects as follows.

For the purpose of facilitating the processing of personal information, we entrust such processing work as follows, and we strictly comply with the necessary matters to ensure that personal information is managed safely upon entrustment in accordance with the relevant laws and regulations.

회사는 효율적인 업무 수행을 위하여 아래와 같이 국외 법인에 개인정보의 처리를 위탁하고 있습니다. 개인정보의 국외이전을 거부하시려면 본 방침에 기재된 연락처로 연락주시기 바랍니다. 다만 국외이전을 거부하실 경우 서비스의 제공이 제한될 수 있습니다. 

For the purpose of efficiency, we entrust the processing of personal information to the overseas entities specified below. If you want to submit objections against overseas transfer of personal information, please, contact us as stipulated in this Notice. However, please, note that in case of your refusal of overseas transfer of personal information, our services may be restricted.

6. Your rights 

정보주체는 회사에 대해 언제든지 개인정보 열람·정정·삭제·처리정지 요구 등의 권리를 행사할 수 있습니다. 만 14세 미만 아동에 관한 개인정보의 열람 등 요구는 법정대리인이 직접하여야 하며, 만 14세 이상의 미성년자인 정보주체는 정보주체의 개인정보에 관하여 미성년자 본인이 권리를 행사하거나 법정대리인을 통하여 권리를 행사할 수도 있습니다. 

Data subjects may, at any time, exercise their right to access, rectify, erase, or suspend the processing of their personal information against the Company. Requests for access to personal information, etc. concerning children under the age of 14 must be made directly by a legal representative, and data subjects, who are minors over the age of 14, may exercise their rights regarding their personal information by themselves or through their legal representatives. 

정보주체는 회사에 대한 서면, 전자우편 등을 통하여 위 권리를 행사할 수 있으며, 권리 행사는 정보주체의 법정대리인이나 위임을 받은 자 등 대리인을 통하여도 할 수 있습니다. 회사는 정보주체의 권리행사 사실을 인지하는 경우 이에 대해 지체없이 조치하겠습니다. 

Data subjects may exercise the above rights in writing or by email, etc. against the Company, and the rights may also be exercised through an agent, such as a legal representative of the data subjects or an authorised attorney-in-fact. In the event that we acknowledge that the data subjects exercise their rights, we will take the necessary action without delay. 

회사는 법률에 명시된 타당한 사유 또는 그에 상응하는 사유가 있는 경우에만 위와 같은 요청을 거부할 수 있습니다. 

We may refuse the above requests only if there are fair reasons or equivalent reasons for such refusal as specified in the applicable laws.

이 개인정보처리방침은 관련 법률 및 규정, 지침, 회사의 내부 운영 방침에 따라 수정될 수 있습니다. 이 개인정보 처리방침이 실질적으로 수정되는 경우, 회사 웹사이트의 메인 페이지 또는 별도의 웹페이지에 안내 게시판을 마련하여 공지하거나 서면, 팩스 또는 이메일로 알려 드립니다. 

This Privacy Policy is subject to change in accordance with applicable laws and regulations, guidelines, and our internal operating policies. In the event of any material changes to this Privacy Policy, we will notify you of such changes by updating this webpage, in writing, by fax or by e-mail.
